H&C Cases

H&C cases are those under which people might be granted permanent residency on Humanitarian and compassionate grounds. In most of the cases, the applications get accepted though several cases are registered where the applicants do not get H&C consideration. Therefore a special focus in required is filling the applications.

There are and not lots of factors working behind the scenes. The deciding authority will check every possible input related to the immigrant. Then they would consider the chance of immigration for the applicant. So the applicant needs to wait till all the rules get checked thoroughly!

Who can one get a Visa on H&C?

A person can apply for permanent residence from Canada on H&C grounds if:

  • He/she is a foreign national who is currently living in Canada
  • He/she needs an exemption from one or more requirements of IRPA or regulations in order to apply for a permanent Canadian residence.
  • He/she believes H&C considerations justify granting the needed exemption
  • He/she is not eligible to apply for a permanent residence within Canada in the following cases:
    • if their spouse is a Canadian resident
    • if he/she are taking care of people or children with high medical needs
    • if he/she is a convention refugee and protected person and
    • if he/she holds a temporary resident permit.
